本応募規約は、モンデリーズ・ジャパン株式会社(以下「当社」という)及び当社のグループ会社であるモンデリーズ・グローバルLLCが提供する「オレオ リフトオフキャンペーン」(以下「本キャンペーン」という)に関する各種応募条件等を規定することを目的としています。本キャンペーンをご利用・ご応募いただく際には本応募規約をよくお読みいただき、ご同意いただける場合に限り、ご利用・ご応募ください。当社は本応募規約の全部又は一部を本キャンペーンの応募者(以下「本応募者」という)に事前に通知することなく、任意に改定することができ、それらは本キャンペーン全期間に適用されるものとします。

1. キャンペーン概要

キャンペーン期間中にキャンペーンサイトからご応募いただくと、当社より抽選で1名様に「『フロリダケネディ宇宙センターツアー』への旅（アメリカ フロリダ オーランドへの5泊7日旅行）」にペアでご招待いたします。さらに当社のグループ会社であるモンデリーズ・グローバルLLCより、日本・インド・メキシコの各国の当選者合計3名の中から抽選で1名様をSpace Perspective社「Spaceship Neptune flight体験」（『フロリダ ケネディ宇宙センターツアー』への旅（アメリカ フロリダ オーランドへの5泊7日旅行）の旅行期間中に行われます。）へご招待いたします。
本旅行は2025年に実施を予定しておりますが、空き状況により変更になる場合がございます。
またSpaceship Neptune flight体験は諸般の事情により実現しない可能性があり、その場合は、代わりに賞金の提供とさせていただく可能性がございます。

2. 応募資格

• ・21歳以上であること。
• ・日本国内に居住しており、連絡先が日本国内の方。
• ・パスポート（滞在期間＋6ヶ月間有効なパスポート）取得済みの方。
• ・日程は空き状況により変更になる可能性があるため、日程変更を許諾いただける方。
• ・Spaceship Neptune flight体験が2025年以降に延期される可能性があることに同意いただける方。
• ・Spaceship Neptune flight体験に関し、本応募規約末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」を読み、内容を理解の上、同意いただける方。
• ・英語で問題なくコミュニケーションできる方(現地では英語での案内となるため、一定の英語力が必要となります。)。
• ・医学的に飛行機に搭乗できる健康状態にある方。
• ・Space Perspective社が定めるSpaceship Neptune flight搭乗条件を満たしている方。
• ・当社所定の免責同意書への同意署名、及び本応募規約などの各種規約等にご同意いただける方。
• ・当社又は当社関係会社に勤務の方とその家族及び本キャンペーンの関係者とその家族は応募できません。
• ・応募過程での不正又は違法行為があった場合は応募を無効とさせていただきます。
• ・その他理由により、本キャンペーンの参加者として参加する資格がないと判断した場合も応募を無効とさせていただきます。

3. 応募期間

さらに各国の当選者合計3名の中から1名様を抽選で『Space Perspective社「Spaceship Neptune flight体験」ご招待』（以下「大賞」という）の当選者として選出します。
※各国当選者の中からの抽選で大賞を落選された場合でも、アメリカ フロリダ オーランドへの5泊7日旅行ペアご招待はプレゼントいたします。
※大賞のSpaceship Neptune flight体験は離陸から着水まで6時間の「Edge of Space：宇宙への入口」への旅です。気球型宇宙船「Neptune」に乗船し、高度100,000フィート（約30Km）の地点で浮遊し、緩やかに降下してから船が待つ海に着水します。
※大賞の当選資格要件については、以下の本応募規約の6.抽選・当選、7.注意事項及び末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」で説明しております。

5. 応募方法

キャンペーンサイトに記載の専用応募フォームより必要事項を入力の上、応募してください。
※ご応募はお一人様一回までとなります。

6. 抽選・当選

• ・応募期間終了後、厳正なる抽選の上、当選者を決定いたします。当選発表は当選された方のみに2024月12月上旬頃、書面またはメールにて当選のご連絡と旅行日程や内容などの詳細をご案内します。その際、当社所定の免責同意書への同意署名をお願いします。
• ・2024年12月30日頃に各国当選者合計3名（日本・インド・メキシコ）の中から大賞の当選者1名を選出します。選出された場合は、さらにキャンペーン事務局より書面またはメールにてご連絡いたします。
• ・応募者様本人の都合により当選の連絡ができない場合、アカウントの無効化や何らかの理由で当選者とご連絡がとれない場合は、当選を無効とさせていただく場合がございます。当選のご連絡後に連絡が取れなくなった場合も同様とします。
• ・当社から当選者への連絡がとれないこと、その他当社の責めに帰さない事由、又は当社の裁量により当選を取り消しとした場合、当社は一切の責任を負いません。予めご了承ください。
• ※当選が無効となった場合、応募資格を満たしていない等で当選権利が無効となった場合、又は当選者が辞退された場合は、再度抽選により当選者を決定いたします。
• ※大賞当選には資格を確認するための必要条件がございます。本応募規約末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」に記載のとおり、「Affidavit of Eligibility」及び「Liability/Publicity Release」（総称して“Prize Claim Documents”）に署名すること、指定された期間内に“Prize Claim Documents”をモンデリーズ・グローバルLLCへ返送すること等。
• ※大賞を受賞できなかった場合、落選された2名にも大賞受賞者の氏名が通知されます。
• ※大賞当選者の資格が確認できなかった場合、又はモンデリーズ・グローバルLLCが大賞当選の資格がないと判断した場合は当選無効となり、残りの他国の当選者から新たに大賞当選者を抽選で選出いたします。

7. 注意事項

＜応募について＞

• ・本キャンペーンにご応募いただいた時点で、本応募規約の全てに同意いただいたものとみなします。本応募規約に記載のない事項については、当社が最終的な決定権を持つものとします。当社の決定に同意できないときは、本応募者は応募を撤回することができます。なお、応募の撤回にともなう費用は、すべて本応募者の負担となります。
• ・本応募規約に違反する応募が発覚した場合は予告なしに応募を無効とさせていただきます。
• ・本キャンペーンへの応募にあたり、応募者が以下のいずれかの行為を行ったものと当社が判断した場合は、当社の判断で応募を無効とする、又は損害賠償を請求することがございます。
  　-法令に違反する行為
  　-犯罪に関連する行為・公序良俗に反する行為
  　-賞品を本キャンペーンの目的とは異なる方法（転売、非難目的を含みます）で使用する行為
• ・応募の確認、修正や取消し、当選確認に関する個別のお問い合わせはお受けできません。
• ・キャンペーンサイト以外からのご応募は受け付けておりません。

＜賞品について＞

• ・当選の権利は本人のみ有効で、第三者へ譲渡はできません。
• ・下記「＜大賞について＞」に記載されている事項を除き、代替・現金との引換はできません。
• ・航空券は空席状況により、ご希望の座席を取ることができない場合がありますので予めご了承ください。
• ・航空券は当選者本人と同行者1名に対してのみ有効です。家族や友人を含む第三者に譲渡することはできません。
• ・当選者と同行者は同じフライトとなります。
• ・航空券は当選者のご自宅から最も近い主要空港（国際線の発着のある空港に限ります。）とオーランド国際空港との間の往復フライトのみとなります。ご自宅から出発空港までの往復交通費は当選者のご負担となります。
• ・予約確定後のフライト変更はできません。
• ・宿泊ホテル、部屋のタイプ、航空会社、シートのクラス等については、ご指定いただけません。
• ・下記の「賞品に含まれない項目」はすべて当選者のご負担となります。渡航に必要な書類（有効なパスポート、ビザ及び旅行保険を含みます）につきましても、当選者の責任で準備いただくものとします。

賞品に含まれない項目：

• ・空港施設使用料と税金
• ・超過手荷物料金

• ・滞在中の個人的飲食代、税金、旅行保険、追加の航空運賃などすべての付属的費用（個人的支出を含む）
• ・渡航時に必要な書類取得費用（パスポート費用、ビザ費用、ESTA（電子渡航認証）申請費用等）

＜大賞賞品について＞

• ・各国当選者3名様の中から抽選で1名様をSpace Perspective社の「Spaceship Neptune flight体験」
  （『フロリダ ケネディ宇宙センターツアー』への旅（アメリカ フロリダ オーランドへの5泊７日旅行）の旅行期間中に行われます）にご招待いたします。（同行者の方は待機となります。）
• ・Spaceship Neptune flight体験は米国フロリダ州スペースコーストから離陸し、最高高度100,000フィートに達します。
• ・Spaceship Neptune flight体験は2025年に実施予定ですが日程はまだ確定しておりません。日程が確定次第ご連絡いたします。『フロリダ ケネディ宇宙センターツアー』への旅（アメリカ フロリダ オーランドへの5泊7日旅行）の旅行日程は、Spaceship Neptune flight体験の実施日程に沿って設定されます。
• ・Spaceship Neptune flight体験は2025年以降に遅れる可能性がございますので予めご了承ください。
• ・Spaceship Neptune flight体験の利用条件として運送約款及びその他の書類に署名いただく必要がございます。
• ・Spaceship Neptune flight体験の実施は保証されるものではなく、Spaceship Neptune flight体験について適用される規約、その他のSpace Perspective社の定める取決めや参加条件が適用されます。
• ・Spaceship Neptune flight体験の参加条件は具体的に決定されておらず、決定後も随時変更される可能性があります。当選者のSpaceship Neptune flight体験への参加権利を取り消す条件には、参加者の健康状態、政府又は規制当局によって課される制限等が含まれ、また参加者が危害を及ぼすリスクがある場合等、Space Perspective社の判断によって参加権利が取り消されることもありますので、予めご了承ください。
• ・Spaceship Neptune flight体験は飛行機に搭乗できる健康状態であれば参加可能ですが、医学的制限がされる場合もございます（妊娠中や心臓疾患のある方は、Spaceship Neptune flight体験への参加前に担当医に確認ください）。健康状態に基づくSpaceship Neptune flight体験への参加可否の最終的な判断は、Space Perspective社が行いますので、予めご了承ください。
• ・Spaceship Neptune flight体験にはリスクが伴います。このリスクに承諾いただけることも参加条件の一つです。
• ・大賞の評価額は125,000USドル(US$125,000)です。
• ・大賞受賞者の資格確認後に、①医師等の判断によりSpaceship Neptune flight体験に参加できない事態となった場合、②モンデリーズ・グローバルLLCのコントロールが及ばない事由によりSpaceship Neptune flight体験が提供できない場合（2025年末までにSpaceship Neptune flight体験の空席がない場合を含みます）、もしくは③大賞受賞者が何らかの理由でSpaceship Neptune flight体験を希望しない事態となった場合、代替の大賞として125,000USドル(US$ 125,000.00)の小切手が賞金として交付されます。
• ・大賞受賞者は居住地である日本国の税法により、大賞又は代替賞金受領に適用されるすべての税金について、個人の責任で税務申告を行い支払う責任を負うこととなります。大賞又は代替賞金の受領に関連して生ずる可能性のある税負担への支援として、37,500USドル(US$37,500)の小切手を追加で提供します。従って、大賞受賞者がモンデリーズ・グローバルLLCより受領する賞品の総額は、162,500USドル(US$162,500)となります。大賞当選者が実際に支払う税金額は、上記の税負担支援金の金額を上回る場合もございます。
• ・なお、代替賞金及び税負担支援金は上記金額に相当する日本円で授与されます。

＜広報について＞

「フロリダ ケネディ宇宙センターツアー」への旅の当選者及び大賞を受賞された当選者の氏名、画像、撮影動画、音声等はモンデリーズ・グローバルLLC及び本キャンペーン関連各社の広告宣伝活動として半永久的に世界中で使用させていただきます。

＜免責について＞

本キャンペーンに参加される場合、以下に同意するものといたします。

• ・モンデリーズ・グローバルLLCに関連するすべての紛争、請求、及び訴訟はニューヨーク州ニューヨークに所在する裁判所によってのみ個別に解決されます。
• ・当社及びモンデリーズ・グローバルLLCの本キャンペーンの参加者に対する損害賠償責任その他の法的責任は、本キャンペーンへの参加に関連する費用を含む実際に発生した自己負担費用に限定されます。いかなる場合も弁護士費用は含まれません。
• ・本キャンペーンの応募者は、本キャンペーンに適用される法で認められる範囲で、いかなる状況においても懲罰的、偶発的、結果的な損害及び実際の自己負担費用以外のその他の損害を請求する権利を有しないものとします。
• ・本応募規約末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」の有効性、解釈及び執行可能性並びに本キャンペーンのうち大賞に関連する参加者及びモンデリーズ・グローバルLLCの権利及び義務に関するすべての事項は、法の選択又は抵触法の規則を参照することなく、ニューヨーク州法に準拠し、同法に従って解釈されるものとします。
• ・本応募規約並びに本応募規約末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」に含まれる詳細と、商業的又はあらゆるメディア（テレビ、ラジオ、デジタル及び印刷広告、販促用パッケージ、ソーシャルメディア、その他の販促媒体を含む）で公的又は私的に配布される本キャンペーン関連資料、又は当社及びモンデリーズ・グローバルLLCからの通信に含まれる条件との間に矛盾がある場合、本応募規約並びに「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」に定める本キャンペーンの条件が優先され適用されるものとします。

＜分離可能性条項（severability）の扱いについて＞

本応募規約並びに本応募規約末尾添付の「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」の各条項のいずれかが適用される法律に違反するなどの理由により無効又は、執行できないとされた場合であっても、本応募規約並びに「THE OREO LIFTOFF GLOBAL SWEEPSTAKES OFFICIAL RULES」に規定される他の条項の有効性や執行可能性について、影響を与えるものではありません。

＜その他＞

• ・本キャンペーンのうち大賞については、モンデリーズ・グローバルLLCにより米国で提供及び実施され、米国の連邦、州、及び地域の法律及び規制の対象となります。
• ・本キャンペーンはやむを得ない事情により、本キャンペーン日程や内容を予告なく変更・中止させていただく場合がございます。
• ・本キャンペーンの当選者は、同時期に実施されている当社の他キャンペーンには当選できない場合がございます。
• ・当社は、当選後に当選者の無効（失格）が発覚した場合、当選の取り消し及び賞品の返還要求を行う事ができます。
• ・利用者が本キャンペーンに関連するあらゆるWebサイトを利用する場合、事務局及び当社は、本キャンペーンに関連するあらゆるWebサイトに掲載される情報の正確性、合法性、道徳性、最新性、適切性などについて保証することはできません。
• ・事務局及び当社は、本キャンペーンに関連するあらゆるWebサイトを利用したこと、又は利用ができないこと、本キャンペーンに関連するあらゆるWebサイトからのリンク先を利用したこと、又は利用ができないことによって引き起こされた損害その他本キャンペーンに関連して生じた損害について、直接的又は間接的な損害を問わず一切責任を負わないものとします。
• ・本キャンペーンの運営を故意に損なう試みがあった場合は刑法および民法に違反する可能性があり、
  法律で認められる範囲で損害賠償を求める権利を留保します。
• ・本キャンペーンに関するお問い合わせは、本キャンペーン事務局までご連絡ください。本キャンペーンの期間中、終了後にかかわらず、当社の他キャンペーン事務局への本キャンペーンに関するお問い合わせにはご対応できません。
• ・本キャンペーンの当選者の税務申告の義務については、本応募規約に記載の情報がすべてとなります。本キャンペーン事務局では、当選者の税務申告についてのお問い合わせにはご対応できません。
• ・当社は、ネットワークの不具合、コンピューターウイルスの影響及びサーバーへの不正アクセスなど当社の支配の及ばない理由により、本キャンペーンの円滑な運営、安全性、公正性等が損なわれると判断したときは、予告なく本キャンペーンを終了もしくはルールを変更することができるものとし、それに関連して生じた参加者の損害等について、一切責任を負いません。

8. 個人情報の取扱いについて

• ・お預かりした個人情報は、本応募規約に明記した使用目的及び以下の目的に必要な範囲内において使用いたします。利用者のご同意がない場合、この目的を超えて使用することはありません。

• ・なお、景品表示法の制限の関係から、重複当選を避ける目的の為に、当選者リストを当社主催の別のキャンペーン懸賞当選者リストと照合することがあります。
• ・その他の個人情報の取り扱いに関しましては、当社ホームページのプライバシー通知をご参照ください。（http://jp.mondelezinternational.com/privacy-policy）
• ・本応募規約に定める個人情報の取扱と当社のプライバシー通知との間に齟齬がある場合は、当社のプライバシー通知の規定を優先するものとします。
  ＜個人情報の利用及び取得＞
  個人情報は、その利用目的をできる限り明確にするとともに、その利用目的の達成に必要な範囲内でのみ取り扱います。
  ＜適正・安全な管理に関するルール＞
  個人情報を取り扱うにあたっては、漏洩、紛失・損失、毀損・改竄又は不正アクセスの防止、その他安全管理の為に必要かつ適切な措置を講じます。
  ＜第三者提供に関するルール＞
  個人情報は、法令などにより開示を求められた場合を除き、原則として、あらかじめご本人の同意を得ないで第三者への提供は行いません。
  ＜開示等に応じるルール＞
  ご本人に関する情報の開示・利用停止などのご請求やその他お客様の個人情報に関するお問い合わせは、キャンペーン事務局までお願いいたします。

本キャンペーンのうち、『フロリダ ケネディ宇宙センターツアー』への旅（アメリカ フロリダ オーランドへの5泊７日旅行）に関するキャンペーンは当社が実施し、大賞に関するキャンペーンはモンデリーズ・グローバルLLC（100 Deforest Ave. East Hanover. NJ／07936-2813）によって実施いたします。
本規約で使用しているすべての商標は、それぞれの所有者に帰属いたします。
Space PerspectiveはSpace Perspective®, Inc.の登録商標です。

THE OREO LIFTOFF GLOBAL SWEEPSTAKES
OFFICIAL RULES

1. GLOBAL SWEEPSTAKES OVERVIEW/ELIGIBILITY REQUIREMENTS: NO PURCHASE OR PAYMENT IS NECESSARRY TO ENTER OR WIN.

Participation in the OREO Liftoff Global Sweepstakes (the “Global Sweepstakes”) sponsored by Mondelēz Global LLC (“Sponsor”) is limited to those three (3) individuals who have been named and verified as top prize winners in separate promotions conducted in connection with this Global Sweepstakes (each, a “Local Promotion”) in India (except the State of Tamil Nadu due to the Tamil Nadu Prize Schemes ( Prohibition) Act, 1979), Japan and Mexico (each, a “Local Market”). If the Sponsor deems a winner of a Local Promotion (other than the Mexico Promotion) ineligible to participate as an entrant in this Global Sweepstakes for any reason, including but not limited to not meeting criteria for space travel set forth by Space Perspective, the prize provider for this Global Sweepstakes, or if a Local Promotion’s winner is disqualified for any reason (including but not limited to declining to participate in the Global Sweepstakes, then an alternate Local Promotion winner will be selected in a random drawing from among the remaining entries in the applicable Local Promotion’s drawing pool, or as otherwise provided in the applicable Local Promotion’s rules.

If the Sponsor deems the winner of the Local Promotion in Mexico ineligible to participate as an entrant in this Global Sweepstakes for any reason, including but not limited to not meeting criteria for space travel set forth by Space Perspective, or if such winner is disqualified for any reason (including but not limited to declining to participate in the Global Sweepstakes, then the individual who accumulated the second most points in the Local Promotion in Mexico will be deemed Mexico’s participant in this Global Sweepstakes.

Space Perspective's space travel requirements (as of the date these Official Rules were written) are addressed in Rule 3, below, and any additional requirements particular to each participant based on their place of residence are described in Rule 4, below. Note that Space Perspective’s requirements for space travel will likely change, as they were not fully established as of the date these Official Rules were written.

The Global Sweepstakes will be conducted in the United States (“U.S.”) and is subject to all applicable U.S. federal, state and local laws and regulations. By taking part in the Global Sweepstakes, participants agree to accept and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to the Global Sweepstakes. If a participant is under the age of majority in the jurisdiction in which he/she resides, his/her parent or legal guardian will be required to execute a written document granting permission for his/her child/legal ward to participate in the Global Sweepstakes, and agreeing to be bound by these Official Rules. The Global Sweepstakes is void where prohibited by law.
The Sponsor, its parent company, affiliates, subsidiaries, advertising and promotion agencies, and the officers, directors and employees of each of the foregoing (collectively the “Sweepstakes Parties”) are not responsible for any technical, human or other difficulties, errors or failures that may occur in connection with the Global Sweepstakes, including but not limited to the selection and announcement of the Grand Prize winner (see prize description in Rule 3, below).

If, in the Sponsor’s opinion, there is any suspected evidence of tampering with any portion of the Global Sweepstakes, or if technical or other difficulties compromise the integrity of the Global Sweepstakes, the Sponsor reserves the right to modify or terminate the Global Sweepstakes in a manner deemed reasonable by the Sponsor, at the Sponsor’s sole discretion. Tampering with the Global Sweepstakes in any way, or other false or deceptive acts by a participant, will result in their disqualification from the Global Sweepstakes and exclusion from the prize drawing. Any attempt by any person to deliberately undermine the legitimate operation of this Global Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law (as well as disqualifying such individual).

2. SELECTION OF GRAND PRIZE WINNER/ODDS OF WINNING:

On or around December 30, 2024, one (1) potential Grand Prize winner will be selected in a random drawing from among the eligible participants. The drawing will be conducted by Sponsor or a designee of Sponsor.

The potential winner will be notified by Sponsor via email, telephone or postal mail and, as a condition of being awarded the Grand Prize, must comply with all requirements for verification of their eligibility. Such requirements include, but may not be limited to, completing and signing an Affidavit of Eligibility and a Liability/Publicity Release (collectively “Prize Claim Documents”) and returning the Prize Claim Documents to Sponsor for receipt within a specified time period. If the potential winner fails to timely comply with this or any other condition, or if Sponsor determines that the potential winner is ineligible to receive the prize for any reason, the potential winner will be disqualified, and the Grand Prize will be forfeited and awarded to an alternate potential winner in a random drawing from among the remaining participants.

The potential winner will be declared the official winner upon verification of their eligibility and compliance with these Official Rules.

Odds. The odds of winning the Grand Prize are one (1) in three (3) based on the participation of all three (3) Local Promotion winners.

3. GRAND PRIZE/APPROXIMATE RETAIL VALUE (“ARV”):

One (1) Grand Prize is available to be won, consisting of the following:
Winner (only) will receive one (1) seat for a flight onboard Space Perspective's Spaceship Neptune on a date to be determined by Sponsor based on availability, with an ARV of One Hundred Twenty-Five Thousand U.S. dollars ($125,000 USD). Space travel has inherent risks. Winner understands and accepts these risks if he or she accepts the Space flight. Space flight reaches a maximum altitude of 100,000 feet. Space flight will take off from Space Coast, Florida, U.S.A. Sponsor has been advised by prize provider that flight is tentatively scheduled to take place on a date to be determined in 2025. Winner will receive confirmation of flight date well in advance of such date. It is possible, due to circumstances beyond the Sponsor’s control, that the flight could be delayed beyond 2025. By accepting the space flight prize, winner agrees to such potential delay.

If the winner is from a jurisdiction in which prize earnings are subject to taxation, Sponsor will also provide winner a check for _Thirty-Seven Thousand Five Hundred U.S. dollars ($37,500.00 USD) (“Tax Gross Up Payment”) that may be used to assist with taxes associated with receipt of this prize. The Grand Prize winner’s actual tax liabilities related to the Grand Prize could exceed the Tax Gross-Up Payment. The Grand Prize winner is solely responsible for all applicable federal, state, or other tax obligations related to the Grand Prize. Sponsor will not provide any further assistance toward the winner’s tax obligations.

If the winner is from a jurisdiction in which prize earnings are not subject to taxation, a Tax Gross-Up Payment will not be awarded.

The total ARV of the Grand Prize if winner is from a jurisdiction in which prize earnings are subject to taxation will be One Hundred Sixty-Two Thousand Five Hundred U.S. dollars ($162,500.000_USD), inclusive of the Tax Gross-Up Payment.

The total ARV of the Grand Prize if the winner is from a jurisdiction in which prize earnings are not subject to taxation will be One Hundred Twenty-Five Thousand U.S. dollars ($125,000.00 USD).

Winner will be required to sign a Contract of Carriage and other documentation provided by Space Perspective as a condition of taking the flight. According to Space Perspective, the experience is designed such that if you are medically fit to board an airplane, you may participate in this experience. Accordingly medical restrictions may apply (for example, winners who are pregnant or have heart conditions may want to confirm with their doctor before accepting the space flight prize). Further, per Space Perspective’s own terms and conditions regarding space flight:

“Flight is not guaranteed and will be subject to conditions of participation, which have not yet been specifically determined and may change from time to time. Conditions under which Space Perspective may cancel [your] right to participate on a Space Perspective flight include but are not limited to, [passenger’s] medical fitness as determined by Space Perspective or its representative(s), limitations or restrictions imposed by any governmental or regulatory authority, or Space Perspective’s determination, in its sole discretion, that [passenger’s] participation presents an unacceptable risk of harm to other [passengers], Space Perspective, or third parties.”

The other specific qualifying criteria for space flight that are in development by Space Perspective will be provided to potential winner by Space Perspective in advance of winner’s acceptance of the space flight prize (if applicable), and winner must comply with all such criteria in order to be eligible for the space flight.

Alternate Grand Prize: If: (a) the Grand Prize winner is deemed ineligible to take a space trip because s/he does not meet criteria required by Space Perspective for the space trip as determined in Space Perspective’s sole discretion or as determined by winner’s doctor; (b) the space trip component of the Grand Prize cannot be awarded as advertised due to circumstances beyond the Sponsor’s control, including but not limited to unavailability of a flight capsule by the end of 2025; or (c) the potential winner does not wish to take the space flight for any reason, then the following Alternate Grand Prize will be awarded in lieu of the space flight: A check in the amount of One Hundred Twenty-Five Thousand U.S. dollars ($125,000.00 USD) made payable to winner.

If the winner is from a jurisdiction in which prize earnings are subject to taxation, then Sponsor will also provide winner a check for Thirty-Seven Thousand Five Hundred U.S. dollars ($37,500.00 USD) (“Tax Gross Up Payment”) that may be used to assist with taxes associated with receipt of this prize. The Grand Prize winner’s actual tax liabilities related to the Grand Prize could exceed the Tax Gross-Up Payment. The Grand Prize winner is solely responsible for all applicable federal, state, or other tax obligations related to the Grand Prize. Sponsor will not provide any further assistance toward the winner’s tax obligations.

If the winner is from a jurisdiction in which prize earnings are not subject to taxation, a Tax Gross-Up Payment will not be awarded.

The total ARV of the alternate Grand Prize if winner is from a jurisdiction in which prize earnings are subject to taxation will be One Hundred Sixty-Two Thousand Five Hundred U.S. dollars ($162,500.00_USD), inclusive of the Tax Gross-Up Payment.

The total ARV of the alternate Grand Prize if the winner is from a jurisdiction in which prize earnings are not subject to taxation will be One Hundred Twenty-Five Thousand U.S. dollars ($125,000.00 USD).

The cash component of the Grand Prize (or cash value of the Alternate Grand Prize, if applicable) will be awarded in the currency of the jurisdiction in which the winner resides.

The Grand Prize and Alternate Grand Prize consist only of the items described above. If winner opts to accept the Grand Prize space trip, then all other costs and expenses in connection with the prize that are not expressly specified above as being included with the prize will be the winner’s responsibility. Such costs and expenses include, but are not limited to, additional transportation, meals, hotel incidentals, and souvenirs. The prize may not be sold, traded, auctioned or otherwise transferred. No more than one (1) Grand Prize (or Alternate Grand Prize, if applicable) will be awarded for any reason. If due to a printing, production, human or other error, more than one (1) prize notification is issued, the one (1) intended prize will be awarded in a random drawing from among all valid recipients of such notifications.

No substitution, transfer or cash redemption of the Grand Prize/Alternate Grand Prize is permitted except as noted herein. Sponsor’s only responsibility if the Grand Prize is unavailable for any reason beyond Sponsor’s control is the awarding of the Alternate Grand Prize described above.

If applicable, winner is responsible for the reporting and payment of all applicable taxes in their jurisdiction of residence, and in connection therewith, will be issued any documentation that Sponsor determines to be required by applicable laws and regulations.

The prize will be awarded provided it is claimed properly in accordance with these Official Rules.

As a condition of being awarded the prize, the winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within a specified time period. Failure to comply will result in forfeiture of the prize and the selection of an alternate winner in a random drawing from among the remaining participants.

4. ADDITIONAL LOCAL MARKET REQUIREMENTS:

The following additional requirements/conditions/limitations apply to participants from each Local Market, respectively:

By participating in this Global Sweepstakes, each participant grants Sponsor and its designees and licensees the right, unless prohibited by applicable law, to use their name, likeness, filmed, photographed or otherwise recorded image, jurisdiction of residence, voice, and statements about this Global Sweepstakes, without limitation and without compensation, further notification or approval, for the purpose of advertising and publicizing the Global Sweepstakes and all matters related to it, in any manner or medium, now or hereafter known, throughout the world in perpetuity.

THE PRIZE WINNER ACKNOWLEDGES THAT THE PRIZE IS AWARDED “AS IS” AND THAT RELEASED PARTIES HAVE NOT MADE, AND ARE NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR, ANY REPRESENTATION, GUARANTEE OR WARRANTY, EXPRESS OR IMPLIED, IN LAW OR IN FACT, RELATIVE TO THE PRIZE, INCLUDING, BUT NOT LIMITED TO ITS QUALITY, MECHANICAL CONDITION OR FITNESS FOR A PARTICULAR PURPOSE.

7. DISPUTES AND ADDITIONAL RELEASES:

By participating in the Global Sweepstakes, participants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Global Sweepstakes or the Grand Prize will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York, New York; (b) any and all claims, judgments, and awards to participants will be limited to actual out of pocket costs incurred, including costs associated with participating in this Global Sweepstakes, but in no event attorneys’ fees; and (c) to the extent permitted by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than for actual out of pocket expenses and any and all rights to have damages multiplied or otherwise increased. If there is any conflict between any details contained in these Official Rules and details contained in Global Sweepstakes-related materials distributed publicly or privately in commerce or in any media (including, but not limited to, television, radio, digital and print advertising, promotional packaging, social media and other promotional media) or in any communications from a representative of Sponsor, the details of the Global Sweepstakes as set forth in these Official Rules shall prevail and govern.

8. SEVERABILITY:

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

9. PRIVACY POLICY:

Any personally identifiable information collected in connection with this Global Sweepstakes will be used by Sponsor, its parent company, affiliates, subsidiaries, agents and marketers, for purposes related to the Global Sweepstakes in accordance with Sponsor’s privacy policy, located at

10. WINNER’S NAME:

The two non-winning entrants will receive notification of the winner’s name from the Sponsor.
